Many people find it morbid to make a will. Planning for your own death can seem like a surreal experience – however, it can make things much easier for your loved ones further down the line.
There is never a right time to make a will – unfortunately we never know when our days are up. This can happen at any age. We encourage people of all ages to make their will. The good thing is that it can always be changed to reflect any changes in your life as you get older. The first step in making your will, is to simply call into our offices. A member of our team will be more than happy to offer any advice in areas you are unsure of. If you know nothing about the process – no problem, we talk you through it all.
You can nominate anybody you like to take possession of your assets in the event of your death. You can leave your items to family, friends, a charity – whoever you like.
Wills
Your will is basically a document that outlines who you wish to distribute your assets amongst. This can be anything, from a treasured item with sentimental value – right up to properties. It can be difficult to decide, however – it can be even more difficult for your loved ones to do. We have often seen family feuds and a lot of bitterness in cases where the family was left to decide where the assets went. Avoid this with a well outlined will. At Babington Clarke & Mooney we can take into consideration any special requests you have.
Probate
“Probate” is the legal certificate that the court issues. This determines that your will has been verified and is in fact your own personal will. This is the document that will give us (or any other solicitor you choose) the authority to issue your belongings to the nominated people. In plain English – this allows us to give your assets to your family / friends as outlined in your will.
Disclaimer: In contentious business, a solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement.
